Course Description:

This course is based on a joint statement from the Department of Justice and the Department of Housing and Urban Development, providing an overview of the Fair Housing Act requirements related to group homes or recovery residences.  Since the federal Fair Housing Act (“the Act”) was amended by Congress in 1988, there has been a great deal of litigation concerning the Act’s effect on the ability of local governments to exercise control over group living arrangements. The Act does not pre-empt local zoning laws. However, the Act applies to municipalities and other local government entities and prohibits them from making zoning or land use decisions or implementing land use policies that exclude or otherwise discriminate against protected persons.  This joint statement provides an overview of the Fair Housing Act’s requirements in this area. Specific topics are addressed in more depth in a question and answer format.

This course is based upon material published by the Department of Justice and the Department of Housing and Urban Development, and is available as an open access article.

This course on the application of the Fair Housing Act to recovery residences is designed for peer residence administrators as part of a certification program.  This course is appropriate for beginning level practitioners who wish to develop their understanding of the impact of the Fair Housing Act on recovery residences.  The course material includes a question and answer section to address specific concerns providers may have.
