Course Description: This course is based upon material published in the U.S. Department of Health and Human Services and is available as an open access article.

The Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule offers clients with important privacy rights and protections with respect to their health information. Ensuring strong privacy protections is critical to maintaining individuals’ trust in their health care providers and willingness to obtain needed health care services, and these protections are especially important where very sensitive information is concerned, such as mental health information. At the same time, the Privacy Rule recognizes situations in which health information may need to be shared to ensure the patient receives the best treatment as well as the individual’s safety. The Rule balances out correctly how to ensure confidentiality while intervening when it interferes with patient safety.

This course on HIPAA privacy rule related to mental health is designed for social workers, professional counselors, psychologists, nurses, and substance abuse counselors, who do clinical work.  This course is appropriate for beginning, intermediate and advanced level practitioners who wish to develop their understanding of HIPAA privacy rule related to mental health. The course material includes a literature review of interventions and frequently asked questions related privacy for mental health clients.  It may also be useful for licensed clinicians who require clinical continuing education courses for license renewal.

  • Identify when it is appropriate under the Privacy Rule for a health care provider to share the protected health information of a patient who is being treated for a mental health condition.

  • Recognize a parent’s right to access the protected health information of a minor child as the child’s personal representative.
